Chula Vista, California becomes model for blight control laws in the US

The San Diego, California suburb of Chula Vista has responded to the recent housing crisis with an aggressive blight control ordinance that compels lenders to maintain the appearance of vacant homes. As foreclosures increase both locally and throughout the United States, the one year old ordinance has become a model for other cities overwhelmed by the problem of abandoned homes that decay into neighborhood eyesores.

Chula Vista city code enforcement manager Doug Leeper told the San Diego Union Tribune that over 300 jurisdictions have contacted his office during the past year with inquiries about the city’s tough local ordinance. Coral Springs, Florida, and California towns Stockton, Santee, Riverside County, and Murietta have all modeled recently enacted anti-blight measures after Chula Vista’s. On Wednesday, 8 October, the Escondido City Council also voted to tighten local measures making lenders more accountable for maintenance of empty homes.

Lenders will respond when it costs them less to maintain the property than to ignore local agency requirements.

Under the Chula Vista ordinance lenders become legally responsible for upkeep as soon as a notice of mortgage default gets filed on a vacant dwelling, before actual ownership of the dwelling returns to the lender. Leeper regards that as “the cutting-edge part of our ordinance”. Chula Vista also requires prompt registration of vacant homes and applies stiff fines as high as US$1000 per day for failure to maintain a property. Since foreclosed properties are subject to frequent resale between mortgage brokers, city officials enforce the fines by sending notices to every name on title documents and placing a lien on the property, which prevents further resale until outstanding fines have been paid. In the year since the ordinance went into effect the city has applied $850,000 in fines and penalties, of which it has collected $200,000 to date. The city has collected an additional $77,000 in registration fees on vacant homes.

Jolie Houston, an attorney in San Jose, believes “Lenders will respond when it costs them less to maintain the property than to ignore local agency requirements.” Traditionally, local governments have resorted to addressing blight problems on abandoned properties with public funds, mowing overgrown lawns and performing other vital functions, then seeking repayment afterward. Chula Vista has moved that responsibility to an upfront obligation upon lenders.

That kind of measure will add additional costs to banks that have been hit really hard already and ultimately the cost will be transferred down to consumers and investors.

As one of the fastest growing cities in the United States during recent years, Chula Vista saw 22.6% growth between 2000 and 2006, which brought the city’s population from 173,556 in the 2000 census to an estimated 212,756, according to the U.S. Census Bureau. Chula Vista placed among the nation’s 20 fastest growing cities in 2004. A large proportion of local homes were purchased during the recent housing boom using creative financing options that purchasers did not understand were beyond their means. Average home prices in San Diego County declined by 25% in the last year, which is the steepest drop on record. Many homeowners in the region currently owe more than their homes are worth and confront rising balloon payment mortgages that they had expected to afford by refinancing new equity that either vanished or never materialized. In August 2008, Chula Vista’s eastern 91913 zip code had the highest home mortgage default rate in the county with 154 filings and 94 foreclosures, an increase of 154% over one year previously. Regionally, the county saw 1,979 foreclosures in August.

Professionals from the real estate and mortgage industries object to Chula Vista’s response to the crisis for the additional burdens it places on their struggling finances. Said San Diego real estate agent Marc Carpenter, “that kind of measure will add additional costs to banks that have been hit really hard already and ultimately the cost will be transferred down to consumers and investors.” Yet city councils in many communities have been under pressure to do something about increasing numbers of vacant properties. Concentrations of abandoned and neglected homes can attract vandals who hasten the decline of struggling neighborhoods. Jolie Houston explained that city officials “can’t fix the lending problem, but they can try to prevent neighborhoods from becoming blighted.”

CEO Robert Klein of Safeguard, a property management firm, told the Union Tribune that his industry is having difficulty adapting to the rapidly changing local ordinances. “Every day we discover a new ordinance coming out of somewhere”, he complained. Dustin Hobbs, a spokesman from the California Association of Mortgage Bankers agreed that uneven local ordinances are likely to increase the costs of lending. Hobbs advised that local legislation is unnecessary due to California State Senate Bill 1137, which was recently approved to address blight. Yet according to Houston, the statewide measure falls short because it fails to address upkeep needs during the months between the time when foreclosure begins and when the lender takes title.

Obama lessens US ban on offshore drilling

US President Barack Obama has announced that he will ease the country’s ban on offshore oil drilling, which has been in place since the 1980s.

According to the plan, offshore drilling would now be allowed in parts of the Atlantic, from Delaware down to 125 miles beyond the shoreline of Florida, in the eastern Gulf of Mexico.

The move, however, does have some restrictions; drilling further northeast or along the West Coast is still prohibited. Contracts in Bristol Bay, Alaska were also suggested, but were scrapped due to environmental concerns.

The president remarked that he decided the move was needed to lessen the country’s need for additional energy, adding that he had studied the issue for over a year. “This is not a decision that I’ve made lightly,” he said.

“We’re announcing the expansion of offshore oil and gas exploration but in ways that balance the need to harness domestic energy resources and the need to protect America’s natural resources,” Obama continued, speaking at Andrews Air Force Base in Maryland. “My administration will consider potential new areas for development in the mid and south Atlantic and the Gulf of Mexico.”

“Drilling alone can’t come close to meeting our long-term energy needs, and for the sake of our planet and our energy independence, we need to begin the transition to cleaner fuels now. I know that we can come together to pass comprehensive energy and climate legislation that’s going to foster new energy — new industries, create millions of new jobs, protect our planet, and help us become more energy independent.”

Obama said that the plan was partially intended to garner support from Republicans in Congress for a climate-change bill to lower greenhouse gas emissions, which has been languishing for months due to lack of support from Republicans.

Some environmental groups, however, condemned Obama’s move. Phil Radford, who is with the Greenpeace group, said that “[e]xpanding offshore drilling in areas that have been protected for decades threatens our oceans and the coastal communities that depend on them with devastating oil spills, more pollution and climate change.” Greenpeace also said that lifting the ban fuelled the US’ “addiction to oil”.

Republican leader for the House of Representatives John Boehner, meanwhile, said he agreed with lifting the ban in the Atlantic, but remarked that it “makes no sense” not to have lifted it in other areas as well. “Opening up areas off the Virginia coast to offshore production is a positive step, but keeping much of the Pacific Coast and Alaska, as well as the most promising resources off the Gulf of Mexico, under lock and key makes no sense at a time when gasoline prices are rising and Americans are asking ‘Where are the jobs?'”, he said.

“Today’s announcement is a step in the right direction, but a small one that leaves enormous amounts of American energy off limits,” said the Senate Minority leader, Republican Mitch McConnell.

According to the US Minerals Management Service, the eastern Gulf of Mexico and parts of the Atlantic south and east of the continent could contain up to 5.8 billion barrels of oil and 40.5 trillion cubic feet of gas. The West Coast, meanwhile, which remains off limits for drilling, contains 10.5 billion barrels of oil with 18 trillion cubic feet of gas.

Australian swimmer Steph Rice announces retirement

One of Australia’s most famous swimming Olympians, Stephanie Rice, 25, announced her retirement earlier today.

The swimmer addressed the Australian public in a video. Here she thanked everyone that has supported her and reflected back on her Olympic career, “It’s sad, I definitely feel like I’m losing a part of myself, but I’m really excited about what’s about to come.”

After several shoulder operations in the lead up to the 2012 London Olympics, Rice fell short of her own expectations. Disappointed with her performance, she says she wanted to give herself a year or two break before making any decisions about the future. “I felt a lot of pressure to live up to everyone’s expectations and fulfil their answers, but I knew I had to take the time for myself to get to the point where I knew 100 percent what I wanted to do,” she says.

Long-time swimming coach Michael Bohl confirmed Rice’s doubts after the London Olympics in a telephone interview with The Associated Press today. “She couldn’t get the best out of herself there,” he says “but with what she endured, she didn’t want to retire with question marks. She wanted a year or two to think about it.”

While Rice has left her career plans unanswered, she hopes to use her popularity with the Australian public as a platform to something else. “It’s safe to say that’s the new goal and new passion for me… to prove myself out of the water.”

Oil spill reported in Gulf of Mexico

At least 21,000 gallons of crude oil has spilled into the Gulf of Mexico near the United States mainland coast, about 30 miles off the shore of Galveston, Texas. The U.S. Coast Guard says that oil is still leaking at a rate of 80 to 400 gallons a day.

The High Island Pipeline began to leak on Sunday and was immediately shut down when a pressure loss was detected. The pipeline is owned by Plains All American Pipeline who state that the incident is “under investigation” and that officials are working to “minimize the impact of the incident.”

“A medium crude oil pipeline ruptured 30 miles southeast of Galveston, Texas, and leaked approximately 21,000 gallons of oil into the Gulf of Mexico Sunday, December 24,” said a press release by Coast Guard.

“There’s a 60-yard-wide oil sheen that extends for about half a mile. It is still leaking slowly, about 80 to 400 gallons a day,” added the Coast Guard.

Reports say that the oil is traveling away from any shoreline and that remaining oil is being suctioned out of the pipeline. Ships in the area have not been diverted.

“All appropriate agencies have been notified. Plains, the U.S. Coast Guard, and the Texas General Land Office are working within a unified command system consisting of Federal and state agencies and oil spill response organizations to manage and mitigate this incident. In addition, Plains has activated its spill response plan to contain and clean up the spill. At present, Plains has mobilized Airborne Support, Inc., Clean Gulf Associates and other additional resources in an effort to minimize the consequences of the incident,” said a press release by the Plains oil company.

So far, no injuries have been reported.

Swiss cement company Holcim Ltd sees net profits jump 67%

Swiss cement firm Holcim Ltd. today reported that net profits jumped by 67% in the first quarter. The company which has operations in over 70 countries revealed that first quarter profits were 169m Swiss francs (€110m; US$141m) up from 101m Swiss Francs last year.

Despite what appears to be a large rise in profits, sales actually fell to 2.7bn Swiss francs — a drop of 1.1 percent. The jump in net profits was largely due to a change in accountancy methods. Operating profits rose just 10% to 411m Swiss francs. This small rise in operating profits was largely due to a major price increase in mature markets such as the US, enabled by strong demand in the marketplace.

Holcim was founded in 1912 in Holderbank, Canton Aargau, Switzerland. Today it employs 46,000 people worldwide and produces over 145m tons of cement annually. It has has recently acquired British- based Aggregate Industries PLC, and gained a controlling interest in India’s No. 2 cement player, Associated Cement Companies Ltd.

Holcim Ltd. is the world’s second-largest cement maker, beaten in size only by Lafarge, a French giant which employs over 77,000 people and sold almost US$20bn worth of building materials last year.
