Although most people never expect to be charged with a crime, there can come a time when that can happen. These types of charges can range form warrants being issued for aid traffic tickets to individuals filing lawsuits against you. The best time to prepare for being charged with a crime is before it ever happens.

Since lawsuits and arrests can move quickly, it is best to understand the basic events that lead up to and constitute being charged with a crime prior to the being charged. If you are knowledgeable about the events beforehand, the process can go easier and hopefully, be less intimidating.

No matter which type of crime you are charged with, the proceedings will usually happen in a predetermined way. First, a warrant will put for your arrest. If a warrant is issued against you, you will usually be notified of the warrant by being served. Being served means that a police officer will locate you and deliver your warrant papers in person. On rare occasions, a person is arrested before being served with a warrant. In these cases, the arresting officer must show the warrant papers within a reasonable amount of time after the arrest has been made.

After you have been arrested, you will be taken to the police station to be booked. Being booked means that you will be fingerprinted and a file will be opened regarding your case. After being booked, you will generally spend a short amount of time in jail while you await your initial hearing and arrange payment for bail.

While you are in jail, you are allowed to contact an attorney. Any person charged with a crime has the right to seek legal representation. It is very important that you at least meet with an attorney before your initial hearing. If you cannot afford an attorney, or you have not chosen an attorney yet, the court can and must appoint a lawyer for you.

During the initial hearing, you will be asked to make a plea of guilty, not guilty or no contest. Your attorney will advise you as to which plea is most favorable for your situation. Even if you are guilty you may opt to plead not guilty. Some defendant’s choose to do this if they feel that the prosecutor does not have enough evidence against them to prove their case. If you plead not guilty, you will be given a trial in which it is the responsibility of the prosecution to prove your guilt. If you plead guilty or no contest, you will not be given a trail, rather you will go straight to a sentencing hearing.

If you are proven not guilty at your trial, you will be released from custody. If you are found guilty, you will be given a sentencing hearing.

A sentencing hearing is a hearing that allows all parties involved in your case to express the facts involving your case that may affect your sentence. These parties could include your accuser, yourself or persons who are defending your case.

After the hearing the judge will consider all evidence presented and then make a decision regarding your sentencing. Your sentencing could include additional jail time, monetary fines, community service or mandatory treatment programs. Depending on the severity of your crime, the evidence against you and your initial plea, the degree of sentencing could vary greatly. For smaller crimes, sentencing may only include a small fine and no jail time.

To insure that all of your rights are protected and that you receive the least sentencing possible, it is important that you hire a competent attorney and become knowledgeable about all of your rights.

In recent days, North Korea has been issuing threats of war to neighbouring South Korea and the United States. There has been an increase in tensions as well as the decision to close off the Kaesong Industrial Park to South Korean workers.

Wikinews interviewed Dr. Robert Kelly of Pusan National University (PNU) in South Korea, who specialises in security and diplomacy, about the recent threats; and Scott Snyder, a North Korean specialist from the Council on Foreign Relations (CFR) in the United States.

((Wikinews)) What is your job role?

Dr. Robert Kelly: I am a Professor of International Relations at PNU.
Scott Snyder: I am a senior fellow for Korea Studies and director of the program for U.S.–Korea policy at CFR.

((WN)) North Korea has issued many threats to South Korea, how likely do you think it is that they will carry out these threats?

RK: Very unlikely. North Korea would lose a war if one began, and if they use nuclear weapons, they will lose all sympathy in global opinion and China will abandon them. The point of these threats is to shake-down SK [South Korea] and its new president for aid, not to start a war.

SS: North Korea’s threats have a variety of purposes. Some are defensive and are primarily meant to deter other countries from taking aggressive stances in the face of North Korea’s own weakness; some are designed tactically to set up for negotiations; some are expressions of intent or aspiration that are beyond the capability of North Korea to implement without facing severe consequences, and some are very specific threats that North Korea will attempt to implement as part of a guerrilla strategy so as to avoid escalation and take advantage of the element of surprise. NK [North Korean] threats should be taken seriously, but evaluated carefully to determine circumstances under which they might actually be carried out.

((WN)) How do people in South Korea feel about North Korea’s nuclear weapon’s programme?

RK: They do not like it of course, but they worry far less about it than outsiders would expect. South Koreans have been living under this shadow for many years. The North has made many threats in the past. So NK is like the boy who cried wolf. No one expects them to launch a weapon.
SS: Increasingly unsettled and concerned, especially about the possibility of being subject to nuclear blackmail. At the same time, this circumstance thus far has had negligible impact on South Koreans’ daily lives.

((WN)) Are South Korean citizens carrying on their day to day lives as normal?

RK: Yes, they are. This is not like the Cuban Missile Crisis when people were emptying the store shelves and building bunkers in their basements. My students are coming and going like normal. Indeed, South Koreans’ composure is very impressive.
SS: Yes.

((WN)) Is North Korea becoming further isolated in the world?

RK: Yes, it is. Threatening nuclear war is a genuine escalation that would alienate any state. Importantly though, NK is already fairly isolated. And because China, its main aid supplier, does not cut it off, further isolation has few practical impacts.
SS: North Korea is increasingly politically isolated but it is comparatively more economically and informationally connected than it was a decade ago.

((WN)) Is the South Korean military well-prepared to deal with any conflicts with the North Korean military?

RK: Yes. The ROKA [Republic of Korea Army, of South Korea] is a modern, well-trained, well-groomed force with substantial technical and organization superiority over the KPA [Korean People’s Army, of North Korea]. To date, the South Koreans have not responded to Northern provocation in order to avoid escalation, not because they are incapable. SK conventional superiority is augmented further by US assistance.
SS: South Korea will decisively win most direct conventional engagements with the North, but is vulnerable in selected theaters where North Korea perceives a lack of readiness or a tactical advantage.

((WN)) Is the closure of Kaesong by North Korea, evidence of further escalating tensions between the two nations?

RK: Yes and no. It is important, because it is a source of hard currency for the North, so its closure suggests that the North is willing to carry genuine costs over this feud. On the other hand, the SK media identified the closure of Kaesong early as a marker of NK seriousness, saying very openly that if NK did not close the facility, they did not really mean what they were saying. In other words, NK was, I think, goaded into closing Kaesong in the war of words, not as a part of any larger strategic plan.
SS: Thus far, it is a symbolic evidence of potential for escalating tensions, but has not yet resulted in material changes. Let’s see how the situation plays out over the next couple of days. Kaesong will only become vulnerable when operations halt and when financial transfers connected to failure of operations become operative.

((WN)) North Korea has moved one of its missiles that carries a large range missile to its East Coast, is this a serious move?

RK: I don’t think it’s as serious a move as the media has made it out to be. First of all they just moved one [missile]. Second of all, it’s not clear that North Korea actually has nuclear warheads that are small enough to actually put on top of missiles; they tell us this but nuclear weapons are actually pretty heavy, which is why nuclear missiles are frequently quite large, so moving the weapon there doesn’t necessarily mean it’s pointed at the United States or Tokyo which I suppose would be the likely targets. It’s not clear that it’s necessarily a nuclear missile and it’s not being fueled or anything so far as I know so again it’s sort of more of the same… bluffing…sort of talking around the issue and sort of saying things that don’t actually have genuine consequences so my sense is it’s more of a war of words.

((WN)) There’s a lot of talk about Kim Jong-un being an inexperienced leader — do you think he knows where the ‘brink’ lies?

RK: That’s actually a really good question. No, I don’t, which is why we’re having this whole conversation. Kim’s father, Kim the second [Kim Jong-il], was actually very good about this, “good” in quotations I suppose. He knew really well how to play this game, he knew really well how to play the South, particularly for aid, rice, assistance, fuel, things like that. The new guy — he’s only been in there for a year-and-a-half, right, 14, 15 months — he didn’t go through the grooming institutions of the regime, he didn’t go through the military or the party. And he certainly has no military training, it’s not like he went to some military institute — he went to some boarding school in Switzerland, or something like that. So it’s not at all clear that this guy knows, sort of how this is done. I have a feeling myself that he’s being egged on by the generals at home, and the generals are really doing this because they do not want the military’s position to be lowered in the new order. Under the previous Kim, under the second Kim [Kim-Jong-il], the military was raised in the constitution to a very high level of importance, they were sort of the primary pillar of the government, this is called the ‘Military First’ policy. I think people now worry that the new Kim — in order to re-start the economy might downgrade the role of the military, and I think that is where all this is coming from. I don’t think they want a war.

((WN)) All of these threats, do you think they are just a way of getting more economic aid from the United Nations?

RK: I wouldn’t say the United Nations [UN] because the UN role in this is actually pretty minimal. It is true that there are some UN specialized agencies that operate in North Korea — the World Food Programme I believe is the big one because North Korea constantly has food problems — and there are western NGOs, and aid groups, charities and stuff like that, also operate in North Korea. I’ve actually been to North Korea and I’ve seen these charities operate. I’ve actually met some of the people who actually live there and do this stuff. But they’re actually pretty small, right? I mean, the North Koreans are pretty worried about Westerners running around in North Korea making trouble and saying things and this and that. Any kind of foreign penetration in North Korea is very, very limited. I think the real issue is actually North Korea’s neighbors, specifically Japan, China, the United States and South Korea. Russia’s really sort of a bit player in this drama. And that’s what they really want, the North Koreans now are very dependent on only the Chinese. They used to be able to play the Chinese off the South Koreans off the Japanese off the Americans and extract aid and concessions from each of those. In the last ten years or so it has become harder to do that — particularly Japan, the United States and South Korea have closed ranks and don’t really deal individually with North Korea anymore. This has pushed North Korea to China. North Korea doesn’t like being dependent on just one player. And so I think that’s what this is an effort to shake up, […] a very difficult game for the North were they an economic colony of China.

A mutated form of the Avian (Bird Flu) virus has been found in a sample taken from a Turkish patient.

The mutated form is said to make the virus easier to attach itself to humans rather than animals says a report in the Nature journal.

The situation is being monitored by the World Health Organization but says “it is too early to know whether the virus is changing in ways that would signal the start of a human flu pandemic,” says Maria Cheng a spokeswoman for the WHO. “It’s one isolate from a single virus from Turkey. The sample suggests the virus might be more inclined to bind to human cells rather than animal cells, but there’s no evidence that it’s becoming more infectious. If we started to see a lot more samples from Turkey with this mutation and saw the virus changing, we’d be more concerned.”

However, the Nature report says there is a second mutation that also “signals adaptation to humans.”

Cheng also said that “flu viruses mutate all the time. For us to assign public health significance to a genetic change we need to match it to what is happening epidemiologically — how the virus is behaving — and clinically — if it’s more or less virulent.”

In Turkey the fatality rate from the Bird Flu is 50% where elsewhere in the world reports of infection were only scattered. Entire families have been affected in Turkey and more reports come out almost every day of mild symptoms.

So far, Turkey has suffered four deaths and 21 infections. In addition to those cases the WHO reports 145 cases and 80 deaths in Cambodia, China, Indonesia, Thailand and Vietnam.

“When this outbreak (in Turkey) was first reported, there was a lot of concern it was behaving differently,” said Cheng. Subsequent investigation, however, has indicated no major behavioral change.

“The team there told us that after two weeks of investigating, they haven’t found substantial differences in the pattern we’ve seen in Southeast Asia,” said Cheng.

The mutations were discovered by scientists in London, England in a lab.

Cheng said this may “signify the virus is trying different things to see if it can more easily infect humans. So far, we haven’t seen that the virus has the ability to do this. But it’s important that we continue monitoring. We would be concerned if we were seeing successive generations of spread of the virus. We haven’t so far. All these people had a very clear history of contact with diseased birds.”

Health officials say that so far they do not see any evidence yet that the virus can spread easily in humans.

The Bird Flu virus, strain H5N1, first started to infect humans in 1997 in Hong Kong. In 2003 it re-emerged and it has so far been difficult to control.

FBI begins widespread financial probe of 26 firms

The FBI is investigating 26 firms and 1,400 individuals involved in the US financial crisis for fraud and “sub-prime lending practices”. Freddie Mac, Lehman Brothers, Fannie Mae and AIG are among the firms being scrutinized after recently receiving federal bailouts.

Investigators, who are cooperating with the IRS, Postal Office, and other federal offices to complete their investigation, are concerned that major corporations may have also forced or bribed ratings agencies to favor them.

The probe, which is in early stages, began eight months ago when the FBI began taking a close look at the mortgage industry and widespread irresponsible loaning practices. At least one corporation has been raided, but so far no evidence of fraud has been found.

The FBI has questioned executives of each of the firms closely, and arrested two in June. An anonymous source told The Times that the firms had been ordered to “hold all papers and e-mails under lock and key” as the FBI scours the finances of each firm.

Many of the companies and individuals being investigated are at the center of the nationwide financial crisis and controversial bailout plans, and have been widely blamed for the country’s financial crisis. The investigation has come at a time when the eyes of many in the US and around the world are turned towards the financial markets, as Congress and politicians scramble to fix the crisis while the election date looms closer.

Officials told CNN that it would be a long time before the investigations were finished, adding a warning: “Don’t expect indictments tomorrow or next week or next month”.

South American Community of Nations announced at Third South American Summit

South American nations began the creation of an international economic and legislative bloc by a declaration made at the Third South American Summit on 8 December. Named the South American Community of Nations, the organization is a step toward greater coordination among South American states.

Two existing South American trade blocs, the Andean Community (Comunidad Andina) and the Southern Common Market (Mercado Común del Sur, or Mercosur), have been combined and three previously uninvolved states included to create the community.

The summit, held between 7-9 December at Cusco and Ayacucho in Peru, was attended by heads of state from Bolivia, Brazil, Chile, Colombia, Guyana, Peru, Suriname, and Venezuela. Foreign ministers attended for Argentina, Ecuador, Paraguay, and Uruguay. The summit was convened principally to sign the two-page Preamble to the Foundation Act of the South American Union on the second day of the summit. Although the Bolivian and Colombian presidents attended the summit, they did not attend the signing ceremony, this instead being done by representatives. Central American states Mexico and Panama attended the ceremony as observers.

The locations for the summit were chosen for their historical significance and their association with events that reflect well on South America. Cusco was the ancient capital of the advanced civilization of the Incas. Ayachucho was the site of an 1824 decisive victory against Spanish troops by the South American independence movement headed by Simón Bolívar. The First and Second South American Summits were held at Brasília, Brazil in September 2000 and Guayaquil, Ecuador in July 2002.

The community will include every state in South America with the exception of French Guiana, itself a territory of France. Bolivia, Colombia, Ecuador, Peru, and Venezuela join SACN from the Andean Community, a trade bloc established in 1969. From the more recent (1991) Mercosur comes Argentina, Brazil, Paraguay, and Uruguay. Guyana, Suriname, two small northeastern countries which had previously not participated in a South American trade bloc, will not immediately join the community. Chile will additionally join; it has, however, been cautious.

SACN is a more ambitious union than the previous Andean Community and Mercosur. It has been established to be more than a trade union. The “ultimate goal, which can hopefully be reached, in time, is the United States of South America,” explains Secretary General of the Andean Community Wagner. A common currency, tariff-free common market, and regional parliament are all proposed in the Cusco declaration.

Many disputes exist between South American nations that may be issues in advancing SACN.

The principal force behind SACN has been Brazil. The First South American Summit was held in Brazil through the efforts of Brazilian President Fernando Henrique Cardoso.

Chile has been an associate member of Mercosur since 1996. It was a member of the Andean Community from its inception in 1969, but withdrew six years later when ruled by General Augusto Pinochet. With 70% of its GDP attributed to foreign trade, Chile has traditionally favored relations with the United States or the Asia-Pacific Economic Cooperation forum over South American agreements.

SACN’s short-term political and economic effects may be limited. The elimination of all trade tariffs has long been a goal of both the Andean Community and Mercosur, but has had little success.

However, 32 construction projects were approved at the summit. Worth US$4.3bn over five years, the projects focus on improving regional infrastructure. The largest is a US$700m road highway that will link Brazil and Peru across the Andes mountains. “These are anchor projects that will be carried out over five years,” said Wagner. “They were chosen because they do not serve merely as corridors between countries and zones, but also as a means of promoting development in border regions, which have traditionally been the poorest and most marginalised in our countries.” Wagner identifies 350 potential infrastructure projects of a combined cost of US$200bn.

Details of the South American Community of Nations are expected to be planned further at the first First SACN Summit in March or April of 2005 in Brazil. Work on a constitution is expected to begin in 2005. A Second SACN Summit of unspecified date is to be held in Bolivia.

Campaigners angry at new British police tracking system

Civil liberties campaigners have reacted angrily to the announcement that the largest police force in Britain has purchased a revolutionary computer system which will allow them to track everything a person does online in a three-dimensional graphic. The Metropolitan Police service, responsible for policing London, announced the purchase of Geotime, a computer program which can correlate information from satellites, mobile phones, social networking websites, IP logs and financial transactions. The software is already used by the U.S. military.

This latest tool could also be used in a wholly invasive way and could fly in the face of the role of the police to facilitate rather than impede the activities of democratic protesters.

Lawyers and campaigners have questioned whether innocent individuals may be tracked by the software, likened to a computer program in the science fiction film Minority Report. Sarah McSherry, a lawyer representing a number of protesters, raised fears officers could breach data protection laws by tracking innocent protesters, endangering the democratic rights of demonstrators. “We have already seen the utilisation of a number of tactics which infringe the right to peaceful protest, privacy and freedom of expression, assembly and movement. All of these have a chilling effect on participation in peaceful protest,” she said. “This latest tool could also be used in a wholly invasive way and could fly in the face of the role of the police to facilitate rather than impede the activities of democratic protesters.”

Geotime correlates information from numerous sources allowing intelligence officers to view effectively every online move made by individuals, and its website says it can link one suspect to others. The computer software can reportedly create links between people and reveal relationships and private communications, disclosing “temporal patterns and behaviours.” A product director at the parent company, Oculus, said the program is available to purchase commercially.

A number of academics and intelligence experts have said the program could lead to more convictions in terrorism and organised crime investigations, with one professor describing its use as “absolutely right.” In contrast, an official at Privacy International called on police to explain how the software would be used. “Once millions and millions of pieces of microdata are aggregated, you end up with this very high-resolution picture of somebody, and this is effectively what they are doing here,” he said. “We shouldn’t be tracked and traced and have pictures built by our own government and police for the benefit of commercial gain.”

Data protection in Britain has become a major issue among public debate in recent years. The most recent controversy to emerge came last week after an elderly man with no criminal record was given permission to take senior officers who systematically recorded details of his attendance at peaceful protests to the High Court. The Metropolitan Police have not yet confirmed how the computer system will be used, but they are researching numerous possibilities; a spokesperson said they were still assessing whether they would permanently use the technology but declined to confirm how much it cost.
