Scottish Justice Secretary ‘acutely aware of unusual publicity’ in Kular case

Wikinews has obtained a letter by Scottish Justice Secretary Kenny MacAskill to former Conservative justice spokesman John Lamont in response to questions raised by our correspondent about the Mikaeel Kular murder case. Wikinews has investigated possible contempt by media publishing potentially prejudicial material, and MacAskill wrote he has “been following the case of Mikaeel Kular and [is] acutely aware of the unusual publicity this case has attracted.”

When Mikaeel Kular, three, vanished from his Edinburgh home last month police and volunteers scoured the capital for him. His body was found in Fife just before midnight on January 17, and his mother was arrested on January 18. That’s when Wikinews first reported on possible widespread contempt by UK and Scottish media.

Our correspondent is based in Scotland and has been advised by a lawyer not to identify anybody detained until they have appeared in court, even if they have been arrested and charged. Professor James Chalmers of the University of Glasgow has since reviewed our coverage and confirmed this position. Despite that a large number of major media outlets identified Rosdeep Adekoya, nee Kular, 33, as the arrested individual.

Adekoya has since been in Edinburgh Sheriff Court charged with murdering her son. She is in custody pending indictment and trial, but any eyewitness evidence may be tainted because her image has been widely published. This is common practice elsewhere in the UK but Scottish justice works differently and courts have viewed publication of photos as potentially prejudicial. Professor Pamela Ferguson of the University of Dundee notes “journalists do seem to be walking a dangerous line if publishing photos etc of suspects.” Crown Office, which is in overall charge of prosecutions, has indicated to journalists that no further comment will be made at least until indictment.

MacAskill however expressed confidence in the Scottish court system to deal with the situation. “I am confident… the courts themselves will intervene if they believe publicity is in danger of being prejudicial.” He also wrote to Lamont that he has faith in the court to successfully direct any jury that may try the case in order to maintain fairness.

The courts have said that the only safe route to avoid committing a contempt is to avoid publishing a photograph

The Contempt of Court Act 1981 is designed to prevent prejudicial material going in front of juries before trial. Although UK-wide legislation, the law is interpreted differently north of the border than in England and Wales. Witnesses in Scotland may be asked to identify accused persons standing in the dock. The BBC College of Journalism advises legal advice be sought ahead of publishing photos and notes it has previously been ruled contempt. The BBC used the accused’s photo prominently in their own online coverage.

Chalmers explains: “It may be a contempt of court to create a substantial risk of serious prejudice to someone’s right to a fair trial. A photograph might do this in a case where identification is an issue; on the face of it, that does not seem especially likely in this case, but it is impossible to know for certain at this point. The courts have said that the only safe route to avoid committing a contempt is to avoid publishing a photograph, but that does not mean that publishing a photograph is automatically a contempt.” MacAskill noted “the kind of issue that publicity might raise may become apparent only during the trial itself.”

Contempt has been a considerable issue in the UK in recent years after high-profile cases. In one instance a charge against serial killer Levi Bellfield was dropped owing to publicity while the jury were deliberating; in another, newspapers were fined and sued for libel over reporting on the arrest of a suspect who turned out to be innocent in a prominent investigation.

A proposal was mooted to ban identification of suspects arrested anywhere in the UK, but this was subsequently shelved. MacAskill confirmed “the Scottish Government is content with the way the courts are operating the rules on contempt of court in Scotland at the moment and has no plans to make changes.” He also wrote of the difficulties with trying to individually cover all eventualities with prescriptive legislation, saying “A trial for a sexual offence will raise very different issues — particularly of protecting victims — from those that are raised by a tax fraud trial.”

MacAskill says it is the Scottish Government’s position that the task of “counterbalancing the public interest in reporting with upholding the criminal law should be left to those whose job it is to do so — the courts and the judiciary, acting in the individual circumstances of the case”.

Sri Lanka accepts ‘One China’ policy

Sri Lankan Ministry Of Foreign Affairs said the government accepts Beijing’s “One China” policy and that Taiwan is an inalienable part of the People’s Republic Of China, according to a March 17 press release.

The current foreign Ministry communiqué, recollects the press communiqué issued by the Foreign Ministers of China and Sri Lanka in Beijing in December 2004. Sri Lanka reiterated its support for Chinese legislative measures to oppose forces seeking to secede from China.

In the communiqué, the Sri Lankan government categorically mentioned, Sri Lanka opposes secessionist actions in any form and fully supports a process of peaceful national reunification. The Sri Lankan government further said, it welcomes growing cross-Straits economic and other exchanges such as the promotion of direct trade, mail, air and shipping links.

In the mean time, Chinese President Hu Jintao issued a presidential order regarding the promulgation of the Anti-Secession Law on March 14, which was adopted at the Third Session of the Tenth National People’s Congress, China’s top legislature.

Journalist, counselor, painter, and US 2012 Presidential candidate Joe Schriner of Cleveland, Ohio took some time to discuss his campaign with Wikinews in an interview.

Schriner previously ran for president in 2000, 2004, and 2008, but failed to gain much traction in the races. He announced his candidacy for the 2012 race immediately following the 2008 election. Schriner refers to himself as the “Average Joe” candidate, and advocates a pro-life and pro-environmentalist platform. He has been the subject of numerous newspaper articles, and has published public policy papers exploring solutions to American issues.

Major explosions at UK oil depot

A series of large explosions have occurred close to Hemel Hempstead Hertfordshire, UK. The source of the explosions has been confirmed as the Hertfordshire Oil Storage Terminal (HOSL), Hemel Hempstead, known locally as the Buncefield complex. Up to 150 fire fighters are reported to be at the scene with 10 fire appliances and 1 specialist foamer.

The first ‘blast’ was heard near Hemel Hempstead on Sunday 11 Dec at 6 am. Further smaller explosions followed at 6:24am , 6:26am, 6:30am. BBC News 24 reported an additional, fourth large explosion. Hertfordshire Police Constabulary are currently treating the explosion as an accident.

Reports say the explosion, which registered 2.4 on the Richter scale, was heard as far away as Oxford, and Whitehall, Central London which is 60km (38 miles) away. Eyewitness statements report that the explosion was heard from at least 160km (100 miles) away and as far away as France and The Netherlands. Pilots reported noticing the blast from the North Sea and the West Country area of the UK. The M1 motorway which runs close by has been closed in both directions near the blast which is causing travel chaos as other roads become congested.

Malcom Stewart, a BBC News24 eyewitness who is a tanker driver for the site has reported that the site supplies several oil companies and is a joint operation between Total UK and Texaco, it is also used by BP, Shell and the British Pipeline association. The complex is not a refinery but a storage facility for refined petroleum awaiting distribution to airports and filling stations. The eyewitness reports that the depot has approximately 20 tanks which can hold about 3 million gallons (11 million litres or 70,000 barrels) each. Another News24 eyewitness has just reported that he has seen at least 5 of these tanks on fire.

The depot operates on a 24 hour basis and is split into 2 parts – aviation fuel and domestic fuel. A number of eyewitnesses have reported on UK news that the aviation fuel side appears to be the part of the site that has been affected.

Local authorities were not immediately available for comment but there have been reports of casualties.

Some reports on live television state that, “Several other neighbours said they did see a plane go into the depot.” BBC News 24 were also discussing the idea a possible plane crash as the cause of the explosions. Hertfordshire police have now gone on the record to say that there is no plane involved (BBC News24).

The police have issued a contact number 0800 096 0095 and asked that people do not call the emergency services in Hertfordshire directly unless it is an emergency.

In addition to being an oil storage depot, it is a major hub on the UK oil pipeline network with pipelines to Killingholme Lindsey Oil Refinery (LOR), Humberside (10 inch), Merseyside (10 and 12 inch), Coryton on the Thames Estuary (14 inch) and Heathrow (6 and 8 inch) and Gatwick airports radiating from it.

The disaster is believed to be the worst explosion at a petrochemical plant in the UK since the Flixborough disaster of 1974.Hertfordshire’s Chief Fire Officer Roy Wilsher said: “This is possibly the largest incident of its kind in peacetime Europe.”

A firefighting press officer said that they are stock piling foam from neighboring regions for a prolonged attach which they hope will stop the spread of the fire, however, the inferno itself will have to burn out which could take between 24 hours and a few days.

Despite the authorities saying that there is no need to panic buy petrol, filling stations have had above average queues since this morning and some small garages have ran out.

Deputy Prime Minister John Prescott has visited the scene.

Training Tree Branches To Go Where You Want

Many people associate pruning with changing the structure of your tree to fit a different shape or style. However, this is not the case. Altering the structure of the tree is known as Tree Training . This is a much better way to develop an alternate form for your tree. Pruning should be used to prevent diseases, prevent lopsidedness, and encourage healthier fruit growth.

Pruning is also used to maintain the proper shape for the tree. For example, if you have an abundance of branches on one particular side of the tree, then you will use pruning to get rid of the larger segments which weigh down the tree to one side. Think about it more in terms of maintaining rather than altering. While pruning is useful occasionally, most of the time you can use training as a healthier and more efficient alternative.

Training has not been around for very long. Through tying down branches or propping them up from the ground, one can direct the growth of the tree to take whatever shape they want. This theory is usually used in the early days of the tree to encourage it to develop fully. If you direct the tree and get it started off on the right foot, you ll save yourself a lot of pruning time later.

Usually, training occurs during the summer. Rather than just cut off all the branches that aren t going in the right way, you try to redirect them. The mechanisms you use can be thought of as orthodontic braces for your fruit tree. They pull or push the branches, like teeth, in whatever direction you want them to go. Eventually they naturally grow that way due to your training.

It can be hard to decide how exactly to train your tree. There are many different forms and shapes to choose from. Some are meant to allow a high density of trees in one orchard, and some are meant to provide maximum fruit bearing per tree. Depending on where your tree is and how you want it to function, you will have to look for different types of forms that will perfectly fit your situation.

The theories of training can also be applied even if you are growing a tree in the traditional (natural) form. Sometimes branches will grow too close together and block each other out, so training them to grow away from each other can prevent the need to prune them later. This is highly beneficial even if you are just growing a tree in your backyard, in a non professional environment.

To train a tree, you will need some sort of outside brace to push or pull a branch. Alternately, if you want to push 2 branches closer together or further apart, you can place something in between them or lash them together with rope. Successfully training your branches just takes a little imagination in deciding what to tie things to and what to push things off of. I have found that stakes, fences, or simply an upright two by four leaning away can work wonders.

There is no tree grower that couldn t benefit from using a little training in their tree growing escapades. Whether you have decided to give your trees a completely new form, or just optimize the branch placement for healthier fruit, there is surely some way that training can benefit you.

Japan’s January exports fall by 46% from last year

According to official figures, Japan’s exports dropped by 46% in January compared to a year ago, the lowest statistics ever to be recorded.

Japan’s exports to the United States plunged by almost 53% in January, with car shipments down by 81%. Exports to the European Union fell by 47%.

The Finance Ministry stated that the trade deficit was 952.6 billion yen (US$9.9 billion), the largest deficit ever recorded. The country’s trade deficit with China increased by 61% to 562.7 billion yen (US$5.86 billion).

“Japan is particularly vulnerable to this downturn because trade is so central to the economy,” said Pascal Lamy, head of the World Trade Organization in a statement during a press conference today.

The demand for Japanese automobiles was hit particularly hard, plunging by 69%. Demand for electronic goods also dropped substantially.

Last week, the government announced that the country’s economy had shrunk at an annualised rate of 12.7% in the last quarter of last year, the fastest contraction in nearly 35 years.

Viktor Schreckengost dies at 101

Viktor Schreckengost, the father of industrial design and creator of the Jazz Bowl, an iconic piece of Jazz Age art designed for Eleanor Roosevelt during his association with Cowan Pottery died yesterday. He was 101.

Schreckengost was born on June 26, 1906 in Sebring, Ohio, United States.

Schreckengost’s peers included the far more famous designers Raymond Loewy and Norman Bel Geddes.

In 2000, the Cleveland Museum of Art curated the first ever retrospective of Schreckengost’s work. Stunning in scope, the exhibition included sculpture, pottery, dinnerware, drawings, and paintings.
